AN ORDINANCE concerning
Towing Company Facility Location
FOR the PURPOSE of specifying that towing companies licensed by the City of Annapolis may locate their facilities in proximity to the City border.
BY repealing and re-enacting with amendments the following portions of the Code of the City of Annapolis, 2014 Edition
Section 7.52.060
Section 7.52.170
WHEREAS, the Code of the City of Annapolis provides for the licensure and supervision of providers of towing services within the City limits; and
WHEREAS, the Annapolis City Council wishes to encourage open market competition among providers of towing services within the City limits; and
WHEREAS, the Annapolis City Council recognizes that towing service providers require specialized equipment to meet the need to tow various sized vehicles; and
WHEREAS, there are a very limited number of providers of towing services maintaining necessary specialized equipment within the City limits.
SECTION 1: BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the Code of the City of Annapolis shall be amended to read as follows:
Chapter 7.52 - Towing Companies
7.52.060 - License-Investigation.
A. The City Clerk, after receipt of an application for a towing license, shall forward the application to the Chief of Police or the chief's designee for investigation and inspection of whether:
1. The applicant has adequate off-street storage facilities REASONABLY CONVENIENT TO, AND within ONE MILE OF, the City limits;
2. The applicant has facilities to provide towing services when requested on a twenty-four-hour basis;
3. The towing vehicles of the applicant are in good mechanical condition, equipped with necessary towing gear and safety apparatus, and are registered as commercial hauling vehicles with the Motor Vehicle Administration.
B. The Chief of Police or the chief's designee promptly shall report the findings to the City Clerk. Thereafter, the City Council shall act upon the application.
C. The City Council may reject an application when it finds that the applicant is not qualified to perform the towing and storage services. The council shall provide an applicant written notice setting forth the grounds for the rejection of the application.
7.52.170 - Residency required.
No person is eligible for a City towing license unless the person has the person's place of business and storage facility connected with the business located REASONABLY CONVENIENT TO, AND within ONE MILE OF, the City.
SECTION II: AND IT BE FURTHER ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that this ordinance shall take effect from the date of its passage.
