AN ORDINANCE concerning
Speed Monitoring Cameras
FOR the purpose of authorizing speed monitoring systems in the City of Annapolis to comply with State law changes; and generally related to traffic monitoring systems in the City.
BY repealing and reenacting with amendments the following portions of the Code of the City of Annapolis, 2025 Edition:

SECTION I: BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the Code of the City of Annapolis shall be amended to read as follows:

Chapter 12.08 - Administration and Enforcement
Section 12.08.140 - Speed monitoring systems
A. Definitions. Terms in the Section shall have the meanings as indicated:
1. Owner shall have the meaning set forth in Section 21-809(a)(3)(i) of the Transportation Article of the Annotated Code of Maryland: "owner means the registered owner of a motor vehicle or a lessee of a motor vehicle under a lease of six months or more."
2. Recorded image shall have the meaning set forth in Section 21-809(a)(4) of the Transportation Article of the Annotated Code of Maryland: "recorded image means an image recorded by a speed monitoring system."
3. Speed monitoring system shall have the meaning set forth in Section 21-809(a)(5) of the Transportation Article of the Annotated Code of Maryland: "speed monitoring system means a device with one or more motor vehicle sensors producing recorded images of motor vehicles traveling at speeds as least twelve miles per hour above the posted speed limit."
4. School zones shall be a zone established in accordance with Section 21-803 of the Transportation Article of the Annotated Code of Maryland.
B. Authority to use speed monitoring systems and use of fines.
1. In accordance with Section 21-809 of the Transportation Article of the Annotated Code of Maryland, the City of Annapolis Police Department may:
a. Use speed monitoring systems for the purpose of determining the speed of a vehicle traveling within a designated school zone.
b. Issue civil citations to vehicle owners based upon the speed recorded by the recorded image of the speed monitoring system.
2. In accordance with Section 7-302 of the Courts and Judicial Proceedings Article of the Annotated Code of Maryland, regarding fines collected as a result of violations enforced by speed monitoring systems, the City may:
a. Recover the costs of implementing and administering the speed monitoring systems.
b. Subject to Section 7-302(E)(4)(i) of the Courts and Judicial Proceedings Article of the Annotated Code of Maryland, spend any remaining balance solely for public safety purposes, including pedestrian safety programs.
c. Subject to Section 7-302(E)(4)(ii) of the Courts and Judicial Proceedings Article of the Annotated Code of Maryland, for any fiscal year, if the balance remaining from the fines collected by the City of Annapolis as a result of violations enforced by speed monitoring systems, after the costs of implementing and administering the systems are recovered, is greater than ten percent of the total revenues of the City of Annapolis for the fiscal year, the City of Annapolis shall remit any funds that exceed ten percent of the total revenues to the Comptroller.
Section 12.08.140 - Traffic Monitoring Systems.
Speed Monitoring Systems.
1. Definition. As used in this section, "speed monitoring system" has the meaning set forth in § 21-809 of the Transportation Article of the Annotated Code of Maryland.
2. Use Authorized.
a. The use of speed monitoring systems in the City of Annapolis pursuant to § 21-809 of the Transportation Article of the Annotated Code of Maryland is hereby authorized.
b. Collection and disposition of costs, fines, penalties, and forfeitures resulting from speed monitoring systems shall be pursuant to § 7-302 of the Courts and Judicial Proceedings Article of the Annotated Code of Maryland.
3. Signage Requirement. In cases where the City relocates or installs a mobile or stationary speed monitoring system at a location where one had not been previously placed, citations shall not be issued:
a. Until the installation of signage pursuant to § 21-809 of the Transportation Article of the Annotated Code of Maryland; and
b. For at least the first 15 calendar days after signage installation at the monitoring site.
4. Use of Fines. Pursuant to § 7-302 of the Courts and Judicial Proceedings Article of the Annotated Code of Maryland, any remaining balance after allocating fines collected from speed monitoring systems shall be used solely for the costs of implementing and administering pedestrian safety, road redesign, and public transit.
SECTION II: AND BE IT FURTHER ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that this ordinance shall take effect upon passage.
