A RESOLUTION concerning

 

Extension of State of Emergency

 

FOR                     the purpose of extending the State of Emergency for the City of Annapolis; and providing for its termination.

 

WHEREAS,                     on December 23, 2021, Mayor Buckley declared a State of Emergency in accordance with the Maryland Code Ann., Public Safety Art., Section 14-111, and Section 11.48.030 of the Annapolis City Code; and

 

WHEREAS,                     there continues to be a significant increase in COVID-19 cases and hospitalization rates around the Country with the continued spread of the Delta variant and the emergence and rapid spread of the Omicron variant; and

 

WHEREAS,                     federal and state warnings regarding illness and deaths resulting from exposure to the COVID-19 virus are ongoing and necessitate the continuation of the December 23, 2021 State of Emergency.

 

NOW, THEREFORE,

 

BE IT RESOLVED BY THE ANNAPOLIS CITY COUNCIL that the State of Emergency that was declared on December 23, 2021 is hereby extended for a further 90 days from the date of passage of this Resolution unless terminated earlier by the Mayor.

 

AND BE IT FURTHER RESOLVED BY THE ANNAPOLIS CITY COUNCIL that the Public Information Officer and the Director of Emergency Management shall immediately disseminate notice of this Extension of the State of Emergency to the appropriate news media and the general public.

 

AND BE IT FURTHER RESOLVED BY THE ANNAPOLIS CITY COUNCIL that all City agencies, departments and offices shall activate the emergency response and recovery aspects of the City Emergency Plans for which they are responsible, and shall take such actions and deploy such resources necessary to further prevent or alleviate the ill effects of the COVID-19 virus in and around the City of Annapolis.

 

AND BE IT FURTHER RESOLVED BY THE ANNAPOLIS CITY COUNCIL that during the State of Emergency, the Mayor's powers include, but are not limited to, the authority to:

 

A.                     Appoint an incident commander;

B.                     Implement all or part of the City's continuity of government plan, continuity of operations plan, or other related programs and plans;

C.                     Declare a curfew in all or any part of the City pursuant to Section 11.40.010 of the City Code;

D.                     Authorize the use of City-owned property by any other governmental agency or person during the State of Emergency;

E.                     Direct the Harbormaster to limit access to City waters or any other action provided in Title 15 of the City Code; and

F.                     Take such other and further actions authorized by the Charter and Code of the City of Annapolis or the Annotated Code of Maryland, or otherwise needed to protect the public health, safety, and welfare of the City of Annapolis.
