AN ORDINANCE concerning

 

Certain Street Parking Updates and Corrections

 

FOR                     the purpose of eliminating outdated language and conflicts in the City of Annapolis code related to Chapter 12.20 - Stopping, Standing and Parking, and Chapter 12.32 - Special Residential Parking Districts; and generally related to parking in the City.

SECTION I:                     BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the Code of the City of Annapolis shall be amended to read as follows:

 

Title 12 - VEHICLES AND TRAFFIC

Chapter 12.20 - Stopping, Standing and Parking

 

12.20.180 Eight-hour parking on King George Street between Wagner Street and the King George Street Bridge.

A.                     It is unlawful and a misdemeanor for the driver of any vehicle to park such vehicle for longer than eight consecutive hours on any day on King George Street between Wagner Street and the King George Street Bridge.

B.                     Any person violating this section, upon conviction, is subject to a fine as established by resolution of the City Council.

C.                     Persons holding a valid special residential parking district No. 1 permit shall be exempt from this restriction.

 

12.20.185 Nine-hour parking on St. John's Street between College Avenue and Calvert Street.

A.                     It is unlawful and a misdemeanor for the driver of any vehicle to park such vehicle for longer than nine consecutive hours on any day on St. John's Street between College Avenue and Calvert Street.

B.                     Any person violating this section, upon conviction, is subject to a fine as established by resolution of the City Council.

C.                     Persons holding a valid special residential parking district No. 1 permit shall be exempt from this restriction.

 

12.20.190 Two-hour parking on State Circle.

A.                     It is a misdemeanor for the driver of any vehicle to park such vehicle for longer than two consecutive hours on any day between the hours of 10:00 a.m. and 8:30 p.m., on State Circle.

B.                     Any person violating this section, upon conviction, is subject to a fine as established by resolution of the City Council.

 

 

12.20.180 - Parking on King George Street between Wagner Street and the King George Street Bridge.

A.                     Parking Hours. All rules and regulations governing parking hours and time limits on the streets referenced in this section shall be promulgated by the City Manager and published on the City of Annapolis website.

B.                     Penalties. It is unlawful and a misdemeanor for the driver of any vehicle to park such vehicle on King George Street between Wagner Street and King George Bridge outside of the posted hours and time limits as from time to time may be set by and under the authority of the City Manager in consultation with the director of the Department of Transportation per Section 12.24.070 of this title.

C.                     Fines. Any person violating this section, upon conviction, is subject to a fine as established by resolution of the City Council.

 

12.20.185  - Parking on St. John's Street between College Avenue and Calvert Street.

A.                     Parking Hours. All rules and regulations governing the parking hours and time limits on the streets referenced in this section shall be promulgated by the City Manager and published on the City of Annapolis website.

B.                     Penalties. It is unlawful and a misdemeanor for the driver of any vehicle to park such vehicle on St. John Street between College Avenue and Calvert Street outside of the posted hours and time limits, as from time to time, may be set by and under the authority of the City Manager in consultation with the director of the Department of Transportation per Section 12.24.070 of this title.

C.                     Fines. Any person violating this section, upon conviction, is subject to a fine as established by resolution of the City Council.

D.                     Exceptions. See Chapter 12.32 of this title for exceptions and additional information on parking described in this subsection.

 

12.20.190 - Parking on State Circle.

A.                     Parking Hours. All rules and regulations governing the parking hours and time limits on the streets referenced in this section shall be promulgated by the City Manager and published on the City of Annapolis website.

B.                     Penalties. It is unlawful and a misdemeanor for the driver of any vehicle to park such vehicle on State Circle outside of the posted hours and time limits, as from time to time, may be set by and under the authority of the City Manager in consultation with the director of the Department of Transportation per Section 12.24.070 of this title.

C.                     Fines. Any person violating this section, upon conviction, is subject to a fine as established by resolution of the City Council.

D.                     Exceptions. See Chapter 12.32 of this title for exceptions and additional information on parking described in this subsection.

 

 

 

Title 12 - VEHICLES AND TRAFFIC

Chapter 12.32 - Special Residential Parking Districts

 

12.32.020  - Parking restrictions within district.

A.                     Residential Parking Districts. Except for areas designated by City signage as metered spaces, reserved parking, and or no parking zones, a residential parking permit authorizes a resident of that district to park permitted vehicles all day on the designated streets within that district. A vehicle is permitted if the vehicle is registered with the City or the authorized agent as a permit holder. See Sections 12.32.150-181 of this chapter for Special Residential Parking Districts information.

1.                     The vehicle displays a permit sticker, tag or barcode and is registered with the City or the authorized agent as a permit holder; or

2.                     The vehicle displays a valid temporary residential parking permit.

B.                     If there is a conflict between the map for any district and/or the listing of streets in the district, the listing of streets shall prevail.

                     Parking Maps.  Parking maps are located on the City's website. Street listings in the City Code prevail over any conflict between the parking map and the parking district street lists in the City Code

C.                     Parking District Eligibility. Except as provided elsewhere in the City Code, a resident is eligible for a residential parking permit only when the resident's address is located on one of the streets within a residential parking district per Sections 12.32.150-181 of this chapter.

 

12.32.060  - Establishment, alteration or elimination by ordinance-Posting.

Within sixty days following the public hearing, the City Council shall act upon the recommendation to create, alter or eliminate a residential parking district. The action shall be by ordinance. Following the creation or alteration of a residential parking district, signs shall be posted indicating the times, locations and conditions under which parking is limited by permitparking restrictions.

 

12.32.070  - Regulations-Promulgation by MayorCity Manager.

Upon the recommendation of the Transportation Board, and in coordination with the Director of Transportation and any authorized agent as defined in Section 12.04.020, the Mayor may promulgate regulations to implement and administer a residential parking permit program. These regulations shall be promulgated only upon the recommendation of the board after an advertised public hearing. Each regulation shall have the force and effect of law not less than forty-five days after its issuance by the Mayor, provided no objection to any regulation has been registered by the City Council by a resolution adopted at a regular or special meeting of the City Council within the forty-five day period.

A.                     The City Manager, in consultation with the Transportation Board, the Director of Transportation and any authorized agent as defined in Section 12.04.020 of this title, shall implement and administer the City's residential parking permit program.

B.                     These regulations shall be promulgated only after an advertised public hearing.

C.                     Each regulation shall have the force and effect of law not less than 45 days after its issuance by the City Manager, unless the City Council adopts a resolution objecting to the regulation within those 45 days.

 

12.32.090 - Resident status.

A.                     Resident status for purposes of obtaining a resident parking permit for a motor vehicle is established by meeting the criteria of any of the enumerated items:

1.                     Applicant has a current Maryland vehicle registration and current Maryland driver's license with an address in parking district,; and

2.                     Applicant is owner of a residential property located in a Special Residential Parking District and the property is designated as the owner's principal residence with the State Department of Assessments and Taxation.; or

3.                     Applicant is lessee of residential property located in a special residential parking district that is licensed as rental unit. Applicant must submit a copy of the lease, and a copy of the current rental unit license. Parking permit expires with lease,; or

4.                     Applicant is on active military status and resides in parking district as reflected in documents issued by United States military authorities.

B.                     The determination of whether an applicant has established resident status shall be made by the Director of Transportation or the Director's designee or the authorized agent.

 

12.32.100 - - Permit-Void.

A permit is void when the licensee no longer resides within the district, as defined in this chapter. A licensee shall remove any permit sticker, tag or barcode from any vehicle registered to park within the district upon moving outside of the district and shall notify the City or the authorized agent. Permits shall be transferred from one vehicle to another during the permit year solely in accordance with regulations established by the Director of Transportation governing such transfers.

 

12.32.120  - Permit-DisplayValidation.

The permit shall be visibly displayed and affixed to the vehicle as prescribed in the regulations. The design and content of the permit shall be defined in the regulations.

 

12.32.130 Permit-Replacement.

A. When a vehicle to which a permit is issued or to which a permit sticker, tag or barcode is affixed is sold, transferred, demolished, or in any other manner rendered unusable to the licensee, the licensee shall remove any permit sticker, tag or barcode from the vehicle and may request the issuance of a replacement permit.

B.                     The licensee shall notify the Director of Transportation or the authorized agent of the change in status of the vehicle.

C.                     An application for a replacement permit shall be per the provisions for an application for an original or renewal permit.

D.                     The replacement permit shall be issued and be valid for the unexpired term of the original permit, except that a replacement permit may not be issued for any motor vehicle for which one or more citations issued by the City for parking violations remain unpaid.

E.                     The original permit is void upon the issuance of the replacement permit. If evidence of the destruction of the original permit is not presented at the time the application for a replacement permit is made, the application shall be treated as though it is for an original permit.

 

 

12.32.140 Permit-Temporary.

A.                     Criteria. The Director of Transportation or the Director's designee or the authorized agent shall issue temporary residential parking permits to an applicant who meets any of the resident status criteria in Section 12.32.090 of this chapter.

1.                     A maximum of ten temporary residential parking permits per residence may be purchased per calendar month, which shall expire on the last day of the calendar month in which the permits were purchased.

2.                     An applicant who meets any of the resident status criteria in Section 12.32.090 may also receive an additional twenty-five temporary residential parking permits per residence per fiscal year, which shall expire on the last day of the fiscal year in which the permits were issued.

3.                     The process for applying for temporary residential parking permits shall be prescribed by the Director of Transportation or the authorized agent.

4.                     The fee for a temporary residential parking permit shall be established by resolution of the City Council.

B.                     Medical Care Worker Parking. A temporary residential parking permit may be issued for the vehicle of a person who is rendering medical care to a resident in a special residential parking district.

1.                     The Director of Transportation or the Director's designee or the authorized agent shall determine eligibility for such a permit.

2.                     At the discretion of the Director of Transportation or the Director's designee or the authorized agent, the permit is transferable.

3.                     The permit is valid for up to one month but may be renewed.

4.                     The fee shall be established by resolution of the City Council but may for good cause be waived by the Director of Transportation.

 

SECTION II:  AND BE IT FURTHER ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the City Manager shall, within no less than 90 days from passage of this Ordinance, promulgate parking hours and time limit rules and regulations for posting and signage in accordance herewith;

 

SECTION III:  AND BE IT FURTHER ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that this ordinance shall take effect upon passage.
