AN ORDINANCE concerning
Department of Transportation Fines and Allowing Fine Waivers
FOR the purpose of allowing the Director of Transportation to waive fines under specific conditions; allowing the City Council to waive transportation fines by resolution; and generally related to the Department of Transportation fines process.
BY enacting with amendments the following portions of the Code of the City of Annapolis, 2026 Edition: Section 12.04.080
SECTION I: BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the Code of the City of Annapolis shall be amended to read as follows:
TITLE 12 - VEHICLES AND TRAFFIC
Chapter 12.04 - General Application Procedures and Fees
Section 12.04.080 - Waiver of Fines.
A. Any fine incurred or otherwise required to be paid pursuant to this title may be waived by the Director of Transportation at the express discretion of either the Mayor or the City Manager in the following instances:
1. The fine is incurred by a City employee while on official City business;
2. The fine is incurred by a third party on official City business at the City’s invitation;
3. The fine is incurred due to extenuating circumstances strictly limited to a sudden, unforeseen, and documented emergency that physically prevented the individual from complying with City parking regulations, and limited to the following:
a. A medical emergency;
b. A vehicle breakdown or immobility; or
c. Compliance with an order of a police officer or firefighter to move the vehicle.
4. The fine is waived by resolution of the City Council pursuant to the guidelines approved by the City Council.
B. The Director of Transportation shall promulgate further rules to implement this section.
SECTION II: AND BE IT FINALLY ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that this ordinance shall take effect upon passage.
