AN ORDINANCE concerning

WRNR Radio Tower Lease With the City

For the purpose of entering a ground lease of the City-owned radio tower located at 25 Silopanna Road with Cortona Media LLC dba WRNR Radio, a Maryland limited liability company; and all matters relating to said lease.

WHEREAS, The City is the fee simple owner of real property located at 25 Silopanna Road, Annapolis, Maryland, as described in a deed dated April 25, 1989, recorded among the land records of Anne Arundel County, Maryland, in Liber 4881, Page 76 (the "Property"); and

WHEREAS, The Property is improved with a self-supporting radio transmitting tower, which is owned by the City, regulated by the Federal Communications Commission (FCC), and identified by FCC registration # ASR1037031; and

WHEREAS, Cortona Media desires to lease a small portion of the Building on the property and the entire Tower, as detailed in the attached lease agreement; and
WHEREAS, Article III, Section 8, of the City Charter authorizes the City Council to lease land upon determining that the land to be leased is not needed for public use or that leasing the land will better serve the public need for which it was acquired or another public need; and

WHEREAS, Article III, Section 8, of the City Charter also mandates that such leases be approved by ordinance of the City Council; and

WHEREAS, Leasing this property will fulfill the public need for which it was acquired, and the property is not currently needed for public use.
