A ORDINANCE concerning
Sidewalk Caf? Hours
FOR the purpose of permanently codifying the authorization in Ordinance 36-12 that permitted sidewalk cafes to remain open during the normal business hours governing such establishments.

WHEREAS, the City Council adopted Ordinance 36-12 on June 10, 2013 that authorized permitted sidewalk cafes to remain open during the normal business hours governing such establishments; and
WHEREAS, Ordinance 36-12 shall be deemed abrogated and of no further effect on June 1, 2014 and stricken from the Code of the City of Annapolis in order to asses any impacts of later sidewalk caf? hours on the surrounding community; and
WHEREAS, no significant adverse community impacts have been reported as a result of the later sidewalk caf? hours; and
WHEREAS, the City Council intends to now permanently codify the changes originally adopted in Ordinance 36-12.

SECTION I: BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that there shall be no abrogation of any of the following from the Code of the City of Annapolis:

CHAPTER 7.42 - SIDEWALK CAFES
7.42.010 Sidewalk caf?-Defined-Permit required.
A. A person shall not construct, maintain, use or operate a sidewalk caf? without first obtaining a permit as provided in this chapter.
B. An application for a sidewalk caf? permit shall be made to the City Clerk on forms provided by the City Clerk. The application shall be made by the operating establishment.
C. A sidewalk caf? permit shall be for one year from May 1st in each year until the following April 30th, except that, for the 1996-1997 term, the permit shall be valid from t...
