AN ORDINANCE concerning
Special Residential Parking District 2: Shipwright Street
FOR      the purpose of removing the area on Shipwright Street zoned WME and the area adjacent to the WME zone on the southwest side of Shipwright Street from Special Residential Parking District No. 2; and providing that a resident who occupies a dwelling unit in a building located in the WME zone on Shipwright Street shall be eligible for a parking permit in Special Residential Parking District No. 2.  
BY         repealing and re-enacting with amendments the following portions of the Code of the City of Annapolis, 2012 Edition
      Section 12.32.160
 
 
WHEREAS,      Shipwright Street gained its name from a ship building business established by Thomas Dodd at the bottom of the street in 1651; and
WHEREAS,      the properties on lower Shipwright have continuously operated in the maritime industry for over 350 years; and
WHEREAS,       the City zoned those properties as a "Waterfront Maritime Eastport" (WME) District in order to preserve the Maritime businesses located thereon; and
WHEREAS,       the properties in the Shipwright Street WME District have operated as a marina since 1947; and
WHEREAS,       the City created Special Residential Parking District No. 2, to include all of Shipwright Street; and
WHEREAS,       the City has not enforced Special Residential Parking District No. 2 below the boundary of the WME District other than occasionally every few years; and
WHEREAS,       an operating marina has the need for parking to be available for periods of longer than two hours for visiting marine trades and for boat owners and their guests; and
WHEREAS,       the City placed a Special Residential Parking District No. 2 sign in the WME District in April 2014 and then began parking enforcement; and
 
WHEREAS,       the owners of the Old Towne Marina at the bottom of Shipwright Street petitioned the Transportation Board to change the boundaries of Special Residential Parking District No. 2 such that the Parking District ends at the upper boundary of the WME District on Shipwright Street; and
WHEREAS,       in accordance with Section 12.32.030 of the City Code, the Transportation Board unanimously recommended to the City Council that Special Residential Parking District No. 2 be altered such that the Parking District ends at the upper boundary of the WME District on Shipwright Street.
 
      SECTION I:      BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the Code of the City of Annapolis shall be amended to read as follows:
 
CHAPTER 12.32 - SPECIAL RESIDENTIAL PARKING DISTRICTS
12.32.160 Special residential parking district No. 2.
A.      There is created a special residential parking district No. 2. The following areas and streets are designated to be within this special residential parking district as shown on Map 12.32.160:
Main Street;
St. Mary's;
Newman;
Green;
Duke of Gloucester;
Franklin from Cathedral to Shaw;
Shaw, from South to Franklin;
South from Shaw to 114 South Street;
Anne Lane;
Richard's Lane;
Charles;
Cathedral from Conduit to South;
Conduit;
Union;
Market;
Revell;
Shipwright, except for the area zoned WME and the area adjacent to the WME zone on the southwest side BEGINNING AT THE INTERSECTION OF MARKET AND SHIPWRIGHT STREET, AND CONTINUING ALONG SHIPWRIGHT STREET FROM NORTHWEST TO SOUTHEAST TO THE NORTHWEST CORNER OF REAL PROPERTY COMPRISING LOT 2 OF PARCEL 1245 (PLAT REFERENCE 5725/0833) KNOWN AS #1 SHIPWRIGHT AND EXTENDING ACROSS, AND PERPENDICULAR TO, SHIPWRIGHT STREET AT THAT POINT; and
Western side of Compromise.
B.      Parking is limited to two hours PER DAY between the hours OF eight 8:00 a.m. and 12:00 a.m. midnight, seven days a PER week, unless the vehicle parked within this area displays the special residential parking permit.
C.      a resident who occupies a dwelling unit in a building located in the WME zone on Shipwright Street shall be eligible for a parking permit in Special Residential Parking District no. 2.
CD.      A resident in WHO OCCUPIES a dwelling unit in a building located on Main Street, on the boundary of Parking Districts 1 and 2 are IS eligible for a permit in one district or the other, but not both. The IF THE building must have been WAS constructed before 1960, the ground must be AND IS used for commercial purposes, and there must be IS no on-site parking ASSOCIATED WITH THE BUILDING OR LAND ON WHICH THE BUILDING IS LOCATED.  Residences located on Franklin Street between Shaw and Cathedral, on the boundary of Parking Districts 2 and 3, are eligible for a permit in one district or the other, but not both.

SECTION II:  AND BE IT FURTHER ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that this Ordinance shall take effect from the date of its passage.
