A ORDINANCE concerning
 
Keeping or Maintaining Chickens Within the City of Annapolis
 
FOR      the purpose of eliminating the sunset provision set forth in Ordinance 53-11 Amended pertaining to keeping or maintaining chickens within the City of Annapolis.
 
BY      repealing the uncodified sunset provision set forth in Section II of Ordinance 53-11 Amended concerning Section 8.04.010 of the Code of the City of Annapolis, 2013 Edition.      
 
WHEREAS, the Annapolis City Council adopted Ordinance 53-11 Amended on April 9, 2012; and
 
WHEREAS, Section II of Ordinance 53-11 Amended included an expiration (or "sunset") provision that would cause the Ordinance to expire on April 9, 2015 and would cause all permits and approvals granted pursuant to that Ordinance to expire unless the City Council took further action to prevent the abrogation of Ordinance 53-11 Amended; and
 
WHEREAS, the Annapolis City Council seeks to eliminate the uncodified sunset provision of Section II of Ordinance 53-11 Amended; and
 
WHEREAS, the Annapolis City Council desires to make permanent all other provisions of Ordinance 53-11 Amended in the interests of those citizens who keep or maintain chickens within the City of Annapolis.
 
SECTION I:  BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the uncodified sunset provision set forth in Section II of Ordinance 53-11 Amended is hereby repealed and of no further effect:
 
SECTION II:  AND BE IT FURTHER ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that this Ordinance shall take effect from the date of its passage. and, three years after the date of passage, and with no further action by this council, this provision of law shall be deemed abrogated, of no further effect and stricken from the Code of the City of Annapolis.
 
SECTION II:  AND BE IT FURTHER ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that all other provisions of Ordinance 53-11 Amended shall remain in effect.
 
SECTION III:  AND BE IT FURTHER ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that this Ordinance shall take effect from the date of its passage.
