AN ORDINANCE concerning

City Code Maximum Penalty Provision

FOR the purpose of amending the City Code to be consistent with the Charter concerning the Maximum Penalty applicable to misdemeanors, infractions and violations proscribed by State Law.


BY repealing and re-enacting with amendments the following portions of the Code of the City of Annapolis, 2015 Edition
1.20.060

BY adding the following portion to the Code of the City of Annapolis, 2015 Edition
1.20.080


SECTION I: BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the Code of the City of Annapolis shall be amended to read as follows:

Chapter 1.20 - GENERAL PENALTY AND MUNICIPAL INFRACTIONS

1.20.060 - Municipal infraction-State provisions.

All provisions of Article 23A, Section 3, OR ITS SUCCESSORS, of the Annotated Code of Maryland relating to municipal infractions are incorporated in this chapter. In the event of any inconsistency between Sections 1.20.020 through 1.20.050 and Article 23A, Section 3, OR ITS SUCCESSORS, the STATE LAW provisions in Article 23A shall prevail.

1.20.080 - Applicability.

NOTHING IN THIS CHAPTER SHALL BE CONSTRUED TO LIMIT THE AUTHORITY OF THE ANNAPOLIS CITY COUNCIL, AT ITS DISCRETION, TO IMPOSE FINES, INCARCERATION OR OTHER PENALTIES OR REMEDIES AS PERMITTED BY MARYLAND LAW.


SECTION II: AND BE IT FURTHER ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that this ordinance shall take effect on the latter of the date of its passage or the effective date of CA-2-16.
