AN ORDINANCE concerning

Snow Emergency Routes

FOR the purpose of establishing that any person who fails to remove a vehicle from a snow emergency route when Phase II or Phase III of the snow emergency plan is in effect shall be in violation of the City Code and subject to the imposition of a fine.

BY repealing and re-enacting with amendments the following portions of the Code of the City of Annapolis, 2015 Edition
12.40.060


SECTION I: BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the Code of the City of Annapolis shall be amended to read as follows:

Chapter 12.40 - SNOW EMERGENCIES

Section 12.40.060 - Authority to remove REMOVAL OF PARKED AND stalled vehicles - PENALTIES.

A. When a snow emergency is in effect, the Police Department may take possession of, remove, tow away and impound any vehicle found NO PERSON SHALL LEAVE ANY VEHICLE parked, stalled, incapable of proceeding under its own power, or left unattended upon any street designated as a snow emergency route. Before the owner may obtain possession of the vehicle, the owner first shall pay the costs of removing the vehicle and any storage charges.

B. ANY PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A MUNICIPAL INFRACTION AS DEFINED BY CHAPTER 1.20 AND IS SUBJECT TO A FINE AS ESTABLISHED BY RESOLUTION OF THE CITY COUNCIL.

C. THE POLICE DEPARTMENT OR THE AUTHORIZED AGENT MAY TAKE POSSESSION OF, REMOVE, TOW AWAY AND IMPOUND ANY VEHICLE FOUND UPON A SNOW EMERGENCY ROUTE IN VIOLATION OF PARAGRAPH...
