AN ORDINANCE concerning

 

Economic Development Division

 

FOR                     the purpose of updating the City Code to reflect the dissolution of the Economic Development Corporation; establish the Economic Development Division; relocate the Economic Development Program from the Mayor’s Office to the Department of Planning and Zoning; and matters generally relating to the Economic Development Division.

 

BY                     repealing and re-enacting with amendments the following portions of the Code of the City of Annapolis, 2015 Edition

BY                     adding the following portions of the Code of the City of Annapolis, 2015 Edition

                     2.46.010

                     2.46.020

 

 

SECTION I:                     BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the Code of the City of Annapolis shall be amended to read as follows:

 

TITLE 2 - Administration

 

Chapter 2.12 - MAYOR

 

Section 2.12.070 - Economic Development Program.

 

A.                     The City of Annapolis shall have an Economic Development Program and, as a part of that program, the City shall:

 

1.                     Create, assist and maintain a nonprofit economic organization for the purpose of implementing the Economic Development Program for the City of Annapolis.

 

2.                     Advocate a review of policies, regulations, and laws and their implementation to encourage sound and balanced economic growth.

 

3.                     Provide for collaboration among those City of Annapolis agencies and departments that are vital to the success of the Economic Development Program.

 

4.                     Attract and retain businesses, including small, minority, and/or disadvantaged enterprises.

 

5.                     Promote the creation and retention of jobs in the City of Annapolis.

 

6.                     Expand the commercial and industrial tax base of the City of Annapolis.

 

7.                     Apply for and the administer grants and loans related to the economic vitality of the City of Annapolis and assist with various tax credit and loan programs offered by the County, State, and Federal governments as these programs relate to the economic vitality of the City of Annapolis.

 

8.                     Work with other municipal officials and private parties in identifying areas of the City in need of economic revitalization and cooperate in the preparation of plans to bring economic revitalization to such areas.

 

9.                     Offer existing businesses and prospective businesses assistance in identifying sources of financing and professional and technical services.

 

10.                     Prepare forecasts and statistics of economic conditions in the City of Annapolis.

 

11.                     Analyze the economic impact of proposed legislation.

 

12.                     Participate in the urban and regional planning activities of the City of Annapolis, Anne Arundel County, and the regional planning organizations consistent with the character of the City of Annapolis.

 

13.                     Serve as a liaison to the business community in the City of Annapolis.

 

14.                     Provide technical assistance and information to the business community and its recognized associations.

 

B.                     Economic Development Corporation.

 

1.                     There shall be an "Annapolis Economic Development Corporation" ("AEDC") which shall be a nonprofit, nonstock corporation organized and operated under the laws of the State of Maryland, headquartered in the City of Annapolis, and qualified for tax-exempt status under 26 U.S.C. § 501.

 

2.                     The AEDC shall be governed by its articles of incorporation and bylaws and shall have as its principal corporate purpose the development and implementation of the City of Annapolis Economic Development Program. The AEDC shall perform, in cooperation with the appropriate City of Annapolis agencies, functions enumerated in Section 2.12.070 of the Code of the City of Annapolis.

 

3.                     Funding. The program may be funded by public and/or private funds, including public funds by the City of Annapolis appropriated through the annual budget. A request for funds for the next fiscal year shall be submitted to the mayor for inclusion in the annual operating budget process. All requests for funds shall accompany the program's proposed budget, which the City Council shall take into consideration when reviewing requests for funds.

 

4.                     Reporting. The Corporation shall submit to the City of Annapolis annually a Reviewed Financial Statement, at a minimum, from an independent public accounting firm and a report on the activities of the Corporation. The chief executive officer shall come before the Economic Matters Committee quarterly to discuss the activities of the Corporation.

 

5.                     Offices. The City of Annapolis may provide office space for the Corporation.

 

 

TITLE 2 - Administration

 

CHAPTER 2.46 - ECONOMIC DEVELOPMENT DIVISION.

 

2.46.010  ESTABLISHED

 

THE CITY OF ANNAPOLIS SHALL HAVE AN ECONOMIC DEVELOPMENT DIVISION UNDER THE DEPARTMENT OF PLANNING AND ZONING.

 

2.46.020  ECONOMIC DEVELOPMENT PROGRAM

 

THE ECONOMIC DEVELOPMENT DIVISION SHALL BE RESPONSIBLE FOR IMPLEMENTING AN ECONOMIC DEVELOPMENT PROGRAM AND, AS A PART OF THAT PROGRAM, THE DIVISION SHALL:

 

1.                     ADVOCATE FOR A REVIEW OF POLICIES, REGULATIONS, AND LAWS AND THEIR IMPLEMENTATION TO ENCOURAGE SOUND AND BALANCED ECONOMIC GROWTH.

 

2.                     PROVIDE FOR COLLABORATION AMONG THOSE CITY OF ANNAPOLIS AGENCIES AND DEPARTMENTS THAT ARE VITAL TO THE SUCCESS OF THE ECONOMIC DEVELOPMENT PROGRAM.

 

3.                     ATTRACT AND ENCOURAGE THE RETENTION OF BUSINESSES, INCLUDING SMALL, MINORITY, AND/OR DISADVANTAGED ENTERPRISES.

 

4.                     PROMOTE THE CREATION AND RETENTION OF JOBS IN THE CITY OF ANNAPOLIS.

 

5.                     ADVOCATE FOR THE EXPANSION OF THE COMMERCIAL AND INDUSTRIAL TAX BASE OF THE CITY OF ANNAPOLIS.

 

6.                     APPLY FOR AND ADMINISTER GRANTS AND LOANS RELATED TO THE ECONOMIC VITALITY OF THE CITY OF ANNAPOLIS AND ASSIST WITH VARIOUS TAX CREDIT AND LOAN PROGRAMS OFFERED BY THE COUNTY, STATE, AND FEDERAL GOVERNMENTS AS THESE PROGRAMS RELATE TO THE ECONOMIC VITALITY OF THE CITY OF ANNAPOLIS.

 

7.                     WORK WITH OTHER MUNICIPAL OFFICIALS AND PRIVATE PARTIES IN IDENTIFYING AREAS OF THE CITY IN NEED OF ECONOMIC REVITALIZATION AND COOPERATE IN THE PREPARATION OF PLANS TO BRING ECONOMIC REVITALIZATION TO SUCH AREAS.

 

8.                     OFFER EXISTING BUSINESSES AND PROSPECTIVE BUSINESSES ASSISTANCE IN IDENTIFYING SOURCES OF FINANCING AND PROFESSIONAL AND TECHNICAL SERVICES.

 

9.                     PREPARE FORECASTS AND STATISTICS OF ECONOMIC CONDITIONS IN THE CITY OF ANNAPOLIS.

 

10.                     ANALYZE THE ECONOMIC IMPACT OF PROPOSED LEGISLATION.

 

11.                     PARTICIPATE IN THE URBAN AND REGIONAL PLANNING ACTIVITIES OF THE CITY OF ANNAPOLIS, ANNE ARUNDEL COUNTY, AND THE REGIONAL PLANNING ORGANIZATIONS CONSISTENT WITH THE CHARACTER OF THE CITY OF ANNAPOLIS.

 

12.                     SERVE AS A LIAISON TO THE BUSINESS COMMUNITY IN THE CITY OF ANNAPOLIS.

 

13.                     PROVIDE TECHNICAL ASSISTANCE AND INFORMATION TO THE BUSINESS COMMUNITY AND ITS RECOGNIZED ASSOCIATIONS.

 

14.                     SERVE AS A LIAISON TO THE ANNE ARUNDEL COUNTY ECONOMIC DEVELOPMENT CORPORATION, OR ITS SUCCESSOR.

 

 

SECTION  II:  AND  BE  IT  FURTHER  ESTABLISHED  AND  ORDAINED  BY THE ANNAPOLIS CITY COUNCIL that this ordinance shall take effect from the date of its passage.
