AN ORDINANCE concerning

 

Extending Hours in Parking District 3

 

FOR                     the purpose of extending the Special Residential Parking District hours on certain streets in Murray Hill to midnight, seven days a week.

 

BY                        repealing and re-enacting with amendments the following portions of the Code of the City of Annapolis, 2015 Edition

 

                     Section 12.32.170

 

WHEREAS,                     the majority of Special Residential Parking District (SRPD) 3 and all of SRPD 4 are in effect from eight a.m. to six p.m., Monday through Friday; and

 

WHEREAS,                     the commercial success of the MX Zone between Church Circle and Westgate Circle has increased the number of customers, clients, patrons, and employees that visit the area with their automobiles; and

 

WHEREAS,                     increased parking demand now saturates the residential areas adjacent to the MX Zone in the evenings and on weekends; and

 

WHEREAS,                     three City parking garages and additional private garages are available and open to the public along the MX Zone; and

 

WHEREAS,                     Section 12.32.030 of the Code of the City of Annapolis provides that residents may petition the Transportation Board to create, alter, or eliminate SRPDs; and

 

WHEREAS,                     residents of Murray Hill petitioned the Transportation Board to extend the hours of SRPD 3 to midnight, seven days a week on certain streets within Murray Hill; and

 

WHEREAS,                     residents of President’s Hill petitioned the Transportation Board to extend the hours of SRPD 4 to midnight, seven days a week on the streets within President’s Hill; and

 

WHEREAS,                     the Transportation Board received these petitions at their meeting on April 22, 2016, deliberated upon them, and voted to recommend the requested changes to the City Council; and

 

WHEREAS,                     the Transportation Board notified the Council of its recommendation on May 23, 2016; and

 

WHEREAS,                     Sections 12.32.050 and 12.32.060 of the Annapolis City Code require the City Council to prominently post notice within the area under consideration, hold an advertised public hearing, and act upon the Transportation Board’s recommendation by Ordinance within 60 days.

 

WHEREAS,                     Ordinance O-26-16 proposing to Expand Hours in Parking Districts 3 an 4 was accepted for consideration by the City Council under First Reader on June 13, 2016; and

 

WHEREAS,                     O-26-16 was duly posted and a Public Hearing was held on July 11, 2016; and

 

WHEREAS,                     O-26-16 was considered by the Public Safety Committee and recommended to the Council with amendments on July 18, 2016; and

 

WHEREAS,                     O-26-16 was considered by the Transportation Committee which recommended amendments on July 19, 2016; and

 

WHEREAS,                     O-26-16 was considered by the Transportation Board which recommended adoption of the ordinance with modifications to certain amendments on July 27, 2016; and

 

WHEREAS,                     the Transportation Committee reconsidered O-26-16 and recommended it to the City Council with revised amendments on September 20, 2016; and

 

WHEREAS,                     the Presidents Hill Residents Association requested prompt consideration of O-26-16 while the Murray Hill Residents Association requested postponement for further community conversation; and

 

WHEREAS,                     the City Council adopted the changes recommended in O-26-16 as Amended for SRPD 4 on September 26, 2016; and

 

WHEREAS,                     the petitions and recommendations for extending the hours of SRPD 3 remain outstanding.

 

SECTION I:                     BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the Code of the City of Annapolis shall be amended to read as follows:

 

CHAPTER 12.32 - SPECIAL RESIDENTIAL PARKING DISTRICTS

12.32.170 - Special residential parking district No. 3.

 

A. There is created a special residential parking district No. 3. The following areas and streets are designated to be within this special residential parking district as shown on Map 12.32.170:

 

Southside of West Street from Church Circle to SouthgateMONTICELLO Avenue;

Shaw from Lafayette to Franklin; Dean;

City Gate;

Larkin;

Water;

Franklin, from Cathedral to Spa Creek;

North and South Acton;

Murray;

Colonial, from Murray to Steele Avenue;

Morris;

Lafayette, from West to Monticello;

Steele;

Stehle;

Stewart;

Southgate;

Thompson;

Cheston;

Taney;

Monticello Avenue from West Street to Stehle Street;

Brooke Avenue;

Amos Garrett Boulevard from Academy Street to West Street (not including sections in the MX zone); Academy Street from Amos Garrett Boulevard to Archwood Avenue;

Archwood Avenue from Academy Street to Stehle Street;

Smith Avenue from Chase Street to Amos Garrett Boulevard;

Granville Avenue;

Constitution Avenue;

Constitution Square;

and German Street.

 

B. A City resident living on a corner adjacent to a street located in residential parking district No. 3, but whose street address is not included in the residential parking district shall have the option of purchasing a residential parking permit.

 

C. ON THE STREETS LISTED BELOW, PARKING IS LIMITED TO TWO HOURS PER DAY BETWEEN THE HOURS OF EIGHT A.M. AND MIDNIGHT, SEVEN DAYS A WEEK, INCLUSIVE, UNLESS THE VEHICLE PARKED WITHIN THIS AREA DISPLAYS THE SPECIAL RESIDENTIAL PARKING PERMIT OR IS OTHERWISE REGISTERED WITH THE CITY AND THE AUTHORIZED AGENT AS A PERMIT HOLDER.

 

DEAN STREET;

SHAW STREET;

CITY GATE LANE;

WATER STREET;

LARKIN STREET;

GERMAN STREET;

COLONIAL AVENUE, FROM MURRAY TO SOUTHGATE AVENUE;

MORRIS STREET;

MURRAY AVENUE FROM COLONIAL TO LAFAYETTE;

AND LAFAYETTE STREET FROM WEST TO SOUTHGATE MURRAY.

 

CD. Except for the streets listed below ON OTHER STREETS, parking is limited to two hours PER DAY between the hours of eight a.m. to six p.m. Monday through Friday, inclusive, unless the vehicle parked within this area displays the special residential parking permit or is otherwise registered with the City and the Authorized Agent as a permit holder. On Dean Street, Shaw Street, City Gate Lane, Water Street, Larkin Street, and German Street, parking is limited to two hours between the hours of eight a.m. and midnight, seven days a week, unless the vehicle parked within this area displays the special residential parking permit or is otherwise registered with the City and the Authorized Agent as a permit holder.

 

DE. (1) Subject to paragraph (2), addresses in the MX Zoning District are not eligible for special residential parking permits.

(2)

(i) Residents of existing buildings along West Street from Church Circle to Madison Place are eligible for a permit in either of the adjoining parking districts. TIF: (a) the building must have beenWAS constructed prior to the establishment of the MX zone,; (b) the ground floor must be IS used for commercial purposes,; and (c) there must be IS no on-site parking.

(ii) RESIDENTS OF SINGLE FAMILY DWELLINGS OR SINGLE FAMILY ATTACHED DWELLINGS THAT WERE CONSTRUCTED PRIOR TO NOVEMBER 14, 2016 ARE ELIGIBLE FOR PERMITS.

 

EF. Residences located on Franklin Street between Shaw and Cathedral, on the boundary of Parking Districts 2 and 3, are eligible for a permit in one district or the other, but not both.

SECTION II:  AND BE IT FURTHER ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that this Ordinance shall take effect FORTY FIVE DAYS from the date of its passage.
