A RESOLUTION concerning

 

EQUAL PROTECTION COMMISSIONTASK FORCE

 

FOR                      the purpose of creating a TEMPORARY ADVISORY TASK FORCE Commission to study and COMMISSIONED TO provide the Mayor and City Council with a public forum FOR STUDYING AND PREPARING REPORTS ABOUT THE ISSUES OF FOREIGN-BORN RESIDENTS OF THE CITY OF ANNAPOLIS to recommend and act to understand, mandate and enforce “equal protection under the law” in Annapolis; and all matters relating to said CommissionTASK FORCE

 

WHEREAS                     the 14th Amendment to the United States Constitution guarantees all persons equal protection of law; and

 

WHEREAS                      the Mayor and City Council have a fundamental and compelling interest in providing all persons in Annapolis with equal protection applicable to the laws of the City as codified in the Annapolis City Code, as revised from time to time; and

 

WHEREAS                     the Mayor and City Council desire to address the concerns, fears and questions raised about THE NEEDS, CIRCUMSTANCES, AND ISSUES OF FOREIGN-BORN RESIDENTS IN THE CITY OF ANNAPOLIS IN EACH OF THE FOLLOWING AREAS: 1) TRANSPORTATION, 2) EDUCATION, (3) COMMUNICATION, 4) ECONOMICS AND FINANCES, 5) SOCIAL AND POLITICAL CONCERNS, 6) HEALTH CARE, AND 7) CITY SERVICES AND OUTREACHmatters of equal protection enforcement of laws under the City of Annapolis jurisdiction.

 

NOW, THEREFORE,

 

BE IT RESOLVED BY THE ANNAPOLIS CITY COUNCIL that the City of Annapolis Equal Protection CommissionTASK FORCE be and the same is hereby appointed.

 

AND BE IT FURTHER RESOLVED BY THE ANNAPOLIS CITY COUNCIL that in support of those purposes:

 

1.                                          The members of the CommissionTASK FORCE shall be no more than NINE (9), with a chair to be elected;

2.                        The members of the CommissionTASK FORCE shall serve without compensation;

3.                        The members of the Commission TASK FORCE shall elect from among their membership a CHAIR vice chair and secretary;

4.                     THE CITY COUNCIL SHALL SOLICIT VOLUNTEERS FOR MEMBERSHIP ON THE TASK FORCE FROM THE ANNAPOLIS AREA.

45.                       The Commission TASK FORCE shall meet publicly at least once a monthQUARTERLY and, where feasible, shall take testimony from the public at each meeting;

56.                        Findings and recommendations OF THE TASK FORCE shall be submitted publicly in a quarterly report to the Mayor and City Council; and

67.                        The CHAIR, VICE CHAIR AND SECRETARY SHALL ENSURE THAT THE business of the Commission TASK FORCE shall be conducted consistent with the provisions of THE MARYLAND OPEN MEETINGS ACT AND Robert’s Rules of Order (11th Edition).

8.                     THE TASKFORCE SHALL HAVE NO AUTHORITY TO RENDER PUBLIC DECISIONS OR OPINIONS, OR ACCEPT COMPLAINTS, OR ACT AS A MEDIATOR TO RESOLVE DISAGREEMENTS;

9.                     IN THE EVENT OF ANY ACTUAL OR PERCEIVED CONFLICTS BETWEEN THE TASKFORCE AND THE HUMAN RELATIONS COMMISSION, THE TASKFORCE SHALL DEFER TO THE AUTHORITY OF SUCH COMMISSION; AND

10.                     THE TERM OF THE TASKFORCE SHALL END ONE (1) YEAR FROM THE DATE OF THIS RESOLUTION, UNLESS THE CITY COUNCIL TAKES FURTHER ACTION TO EXTEND SUCH TERM.
