A CHARTER AMENDMENT concerning

Collection of Taxes

FOR the purpose of removing the 3-year limit for the City to collect property taxes; authorizing collection of taxes in the manner prescribed by the Annotated Code of Maryland; and removing the 3-year bar to recovery for taxes not timely collected.

BY amending the following portions of the City Charter:
Article VII, Section 5.


SECTION I: BE IT RESOLVED BY THE ANNAPOLIS CITY COUNCIL that the Charter of the City of Annapolis shall be amended to read as follows:

Article VII FINANCES

Sec. 5. - Collection of taxes.

All property taxes shall be collected by the finance director within three (3) years after the levy. If the taxes are not collected within three (3) years, the parties from whom such taxes may be demanded may plead this section in bar of any recoveryIN THE MANNER PRESCRIBED BY THE ANNOTATED CODE OF MARYLAND.


SECTION II: AND BE IT FURTHER RESOLVED BY THE ANNAPOLIS CITY COUNCIL that the date of adoption of this Resolution is March 27, 2017, and the amendments of the Charter of the City of Annapolis, hereby enacted shall become effective on May 16, 2017, unless a proper petition for referendum hereon shall be filed as permitted by law within 40 days of adoption, provided a complete and exact copy of this Resolution shall be continuously posted on the bulletin board in the City Hall until May 8, 2017, and provided further that a copy of the title of this Resolution shall be published in "The Capital," a newspaper of general circulation in the City of Annapolis, or in any other newspaper...
