AN ORDINANCE concerning

 

Electronic weapons

 

FOR                     the purpose of repealing Section 11.44.070 of the Code of the City of Annapolis concerning possession and discharge of electronic weapons.

 

BY                     repealing the following portion of the Code of the City of Annapolis, 2016 Edition

                     11.44.070

 

 

SECTION I:                     BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the Code of the City of Annapolis shall be amended to read as follows:

 

TITLE 11 - PUBLIC PEACE, MORALS AND WELFARE

 

Chapter 11.44 - WEAPONS

 

11.44.070 - Electronic weapons.

 

A.                     In this section, "electronic weapon" means a "stun gun" or any similar device, by whatever name, that is designed as a weapon capable of injuring any individual by the discharge of electrical current.

 

B.                     Except as otherwise provided in this Section, no person shall possess, deliver, receive, or discharge any electronic weapon.

 

C.                     This Section shall not apply to any law enforcement officer or member of the Armed Forces authorized to possess an electronic weapon while on duty in the performance of official authorized functions.

 

 

SECTION  II:   AND  BE  IT  FURTHER  ESTABLISHED  AND  ORDAINED  BY THE ANNAPOLIS CITY COUNCIL that this ordinance shall take effect from the date of its passage.
