AN ORDINANCE concerning
Parking Enforcement and Rulemaking Responsibilities
FOR the purpose of updating parking enforcement and rulemaking responsibilities in Chapters 2.36, 12.08 and 12.32 in the Code of the City of Annapolis; and matters generally relating to updating parking enforcement and rulemaking responsibilities.
BY repealing and re-enacting with amendments the following portions of the Code of the City of Annapolis, 2016 Edition

SECTION I: BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the Code of the City of Annapolis shall be amended to read as follows:
TITLE 2 - ADMINISTRATION
Chapter 2.36 - POLICE DEPARTMENT
Section 2.36.080 - Enforcement-Parking of motor vehicles.
The Police Chief is responsible for the planning, development and enforcement of all policies, procedures and regulations related to the parking of motor vehicles in the City including but not limited to the special residential parking permit program as established in Chapter 12.32 of the City Code.
TITLE 12 - VEHICLES AND TRAFFIC
CHAPTER 12.08 - GENERAL PROVISIONS
Section 12.08.010 - Enforcement by police OR AUTHORIZED AGENT.
A. The Police Department, OR AN AUTHORIZED AGENT AS DEFINED IN SECTION 12.04.020, shall enforce this title. A person who refuses or fails to comply with any lawful order, signal or direction of a police officer OR AUTHORIZED AGENT is guilty of a misdemeanor and, upon conviction, shall pay a THE fine of not less than five dollars nor more than one hundred dollars, and court costsSET FORTH IN THE FINES SCHEDULE.
B. Parking district laws shall be enforced by officers of the Parking Enforcement Section of the Police Department OR REPRESENTATIVES OF AN AUTHORIZED AGENT. Except in emergencies, a sufficient number of such officers shall be on duty to effectively enforce the parking district laws between nine a.m. and eight p.m. seven days a week. The number of officers which this section is authorized to employ shall be as provided in the annual operating budget.
Section 12.08.030 - Regulations by Director of Public Works OR DIRECTOR OF TRANSPORTATION.
The IN COORDINATION WITH THE POLICE CHIEF AND ANY AUTHORIZED AGENT AS DEFINED IN SECTION 12.04.020, EITHER THE Director of Public Works OR THE DIRECTOR OF TRANSPORTATION may make and enforce regulations necessary to make effective the provisions of this title and make and enforce temporary regulations to cover emergencies or special conditions.
CHAPTER 12.32 Special Residential Parking Districts
Section 12.32.070 - Regulations-Promulgation by Mayor.
Upon the recommendation of the Transportation Board, AND IN COORDINATION WITH THE POLICE CHIEF AND ANY AUTHORIZED AGENT AS DEFINED IN SECTION 12.04.020, the Mayor may promulgate regulations to implement and administer the A residential parking permit program. These regulations shall be promulgated only upon the recommendation of the board after an advertised public hearing. Each regulation shall have the force and effect of law not less than forty-five days after its issuance by the Mayor, provided no objection to any regulation has been registered by the City Council by a resolution adopted at a regular or special meeting of the City Council within the forty-five day period.
SECTION II: AND BE IT FURTHER ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that this ordinance shall take effect from the date of its passage.
