AN ORDINANCE concerning

Double Parking

FOR the purpose of authorizing double parking for the expeditious loading and unloading of commercial vehicles.

BY repealing and re-enacting with amendments the following portions of the Code of the City of Annapolis, 2016 Edition

Section 12.20.065

WHEREAS, numerous observations by Economic Development associations, resident associations, and the Department of Public Works show commercial vehicles experience difficulties finding space at available loading zones for making deliveries; and

WHEREAS, retail customers experience similar difficulties when transporting bulky merchandise; and

WHEREAS, Section 25-102(a)(1) of the Transportation Article of the Annotated Code of Maryland states that, subject to the provisions of ?21-1003.1 of that article, local authorities have the power to regulate or prohibit the stopping, standing, or parking of vehicles.

SECTION I: BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the Code of the City of Annapolis shall be amended to read as follows:

TITLE 12 - VEHICLES AND TRAFFIC

CHAPTER 12.20 - STOPPING, STANDING AND PARKING

Section 12.20.065 - Parking vehicles alongside of other stopped or parked vehicles.

A. It is unlawful and a misdemeanor for the driver of any vehicle to stop, stand or park such vehicle on the roadway side of any other vehicle that is stopped or parked at the edge or curb of a street, roadway or alley, EXCEPT THAT

1. THE DRIVER OF A COMMERICIAL VEHICLE LAWFULLY OPERATING IN THE STATE OF MARYLAND BETWEEN THE HOURS OF 7:00AM AND 11:00AM MAY STAND THAT VEHICLE ALONGSIDE A VEHICLE PARKED AT THE CURB AT SUCH LOCATIONS WHERE STOPPING,...
