AN ORDINANCE concerning

 

Double Parking

 

FOR                     the purpose of authorizing double parking for the expeditious loading and unloading of commercial vehicles.

 

BY                        repealing and re-enacting with amendments the following portions of the Code of the City of Annapolis, 2016 Edition

                     

Section 12.20.065

 

WHEREAS,                     numerous observations by Economic Development associations, resident associations, and the Department of Public Works show commercial vehicles experience difficulties finding space at available loading zones for making deliveries; and

 

WHEREAS,                     retail customers experience similar difficulties when transporting bulky merchandise; and

 

WHEREAS,                     Section 25-102(a)(1) of the Transportation Article of the Annotated Code of Maryland states that, subject to the provisions of §21-1003.1 of that article, local authorities have the power to regulate or prohibit the stopping, standing, or parking of vehicles.

 

SECTION I:                     BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the Code of the City of Annapolis shall be amended to read as follows:

 

TITLE 12 - VEHICLES AND TRAFFIC

 

CHAPTER 12.20 - STOPPING, STANDING AND PARKING

 

Section 12.20.065 - Parking vehicles alongside of other stopped or parked vehicles.

 

A.                     It is unlawful and a misdemeanor for the driver of any vehicle to stop, stand or park such vehicle on the roadway side of any other vehicle that is stopped or parked at the edge or curb of a street, roadway or alley, EXCEPT THAT 

 

1.                       THE DRIVER OF A COMMERICIAL VEHICLE LAWFULLY OPERATING IN THE STATE OF MARYLAND BETWEEN THE HOURS OF 7:00AM AND 11:00AM MAY STAND THAT VEHICLE ALONGSIDE A VEHICLE PARKED AT THE CURB AT SUCH LOCATIONS WHERE STOPPING, STANDING, OR PARKING IS NOT PROHIBITED FOR THE PURPOSE OF EXPEDITIOUSLY LOADING AND UNLOADING, PROVIDED THROUGH TRAFFIC IS NOT OBSTRUCTED AND PROVIDED THERE IS NO UNOCCUPIED PARKING SPACE OR DESIGNATED LOADING ZONE ON EITHER SIDE OF THE STREET WITHIN 100 FEET THAT CAN BE USED FOR SUCH STANDING.  FOR THE PURPOSE OF THIS PARAGRAPH “EXPEDITIOUSLY LOADING AND UNLOADING” SHALL MEAN ANY PERIOD OF INACTIVITY THAT DOES NOT EXCEED 10 MINUTES.  A VEHICLE STANDING ALONGSIDE A PARKED VEHICLE UNDER THE PROVISIONS OF THIS PARAGRAPH SHALL BE MOVED AT THE DIRECTION OF A LAW ENFORCEMENT OFFICER OR OTHER PERSON AUTHORIZED TO ENFORCE THIS RULE WHO HAS DETERMINED, AT THEIR DISCRETION, THAT THE STANDING VEHICLE IS AN OBSTRUCTION.

 

2.                     THE DEPARTMENT OF TRANSPORTATION MAY ISSUE EACH RETAIL STORE ONE PERMIT THAT, WHEN DISPLAYED IN A NON-COMMERCIAL VEHICLE, ALLOWS THAT VEHICLE TO STAND ALONGSIDE ANOTHER VEHICLE AS THOUGH IT WERE A COMMERCIAL VEHICLE AS DESCRIBED IN PARAGRAPH 1.

 

B.                     Any person violating this section, upon conviction, is subject to a fine as established by resolution of the City Council.

 

 

SECTION II:  AND BE IT FURTHER ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that this Ordinance shall take effect from the date of its passage.
