A RESOLUTION concerning
Stormwater Management INVENTORY AND Watershed Improvement Plan
FOR the purpose of adopting a Stormwater Management INVENTORY AND Watershed Improvement Plan dated March 2017.
WHEREAS, the U.S. Environmental Protection Agency’s Clean Water Act created the National Pollution Discharge Elimination System (NPDES) permit program; and
WHEREAS, under the NPDES permit program the City is subject to the requirements of a Separate Storm Sewer System Phase II General Permit; and
WHEREAS, the City’s current Phase II General Permit expired in 2008 but has been extended by the Maryland Department of the Environment until a new permit is issued; and
WHEREAS, the requirements of a new Phase II General Permit are expected to require the City to treat 20 percent of the City’s impervious areas as of 2002, which is approximately 316 acres, and such treatment must be completed by 2025; and
WHEREAS, the requirements of a new Phase II General Permit are expected to require the City to meet the Chesapeake Bay Restoration Total Maximum Daily Load nitrogen, phosphorus and sediment reduction requirements, as specified by 40 CFR 122.26(b) and 122.32(a)(1); and
WHEREAS, a new Phase II General Permit will continue to require the City to meet the 6 minimum control measures specified by 40 CFR 122.26(b) and 122.32(a)(1), which include: (1) public education and outreach, (2) public involvement and participation, (3) illicit discharge detection and elimination, (4) construction site runoff control, (5) post construction stormwater management and (6) pollution prevention and good housekeeping; and
WHEREAS, the City hired AECOM to create a Stormwater Management Inventory and Watershed Improvement Plan to better position the City in meeting the new permit requirements, which plan shall be amended by the City from time to time as needed.
NOW, THEREFORE,
BE IT RESOLVED BY THE ANNAPOLIS CITY COUNCIL that the Annapolis STORMWATER MANAGEMENT INVENTORY AND Watershed Improvement Plan dated March 2017 is hereby adopted.
AND BE IT FURTHER RESOLVED BY THE ANNAPOLIS CITY COUNCIL THAT THE WATERSHED IMPROVEMENT PLANS OF THE NON-PROFIT ORGANIZATIONS REPRESENTING WATERSHEDS WITHIN THE ANNAPOLIS JURISDICTIONAL LIMITS SHALL BE CONSIDERED ADOPTED AS APPENDICES TO THE STORMWATER MANAGEMENT WATERSHED IMPROVEMENT PLAN ADOPTED THROUGH THIS RESOLUTION.
AND BE IT FURTHER RESOLVED BY THE ANNAPOLIS CITY COUNCIL that this resolution shall take effect from the date of its passage.
