AN ORDINANCE concerning

Wheel Immobilization Devices - Prohibited

FOR the purpose of prohibiting the use of wheel immobilization devices on vehicles parked on public or private property in the City of Annapolis.

BY adding the following portion to the Code of the City of Annapolis, 2016 Edition
12.20.160

BY repealing and reenacting with amendments the following portion of the Code of the City of Annapolis, 2016 Edition
12.20.235


SECTION I: BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the Code of the City of Annapolis shall be amended to read as follows:

TITLE 12 - VEHICLES AND TRAFFIC

Chapter 12.20 - STOPPING, STANDING AND PARKING

Section 12.20.160 - WHEEL IMMOBILIZATION DEVICE - PROHIBITED.

A. FOR PURPOSES OF THIS SECTION, "WHEEL BOOT" INCLUDES A TIRE LOCK, DENVER BOOT, WHEEL CLAMP, OR WHEEL IMMOBILIZER.

B. IT SHALL BE UNLAWFUL FOR A PERSON OR ENTITY TO APPLY OR CAUSE TO BE APPLIED A WHEEL BOOT TO A MOTOR VEHICLE LOCATED ON ANY PUBLIC STREET, ROADWAY, HIGHWAY OR OTHER RIGHT OF WAY, OR A MOTOR VEHICLE LOCATED ON ANY PRIVATE PROPERTY.

C. ANY PERSON VIOLATING THIS SECTION, UPON CONVICTION, IS SUBJECT TO A FINE AS ESTABLISHED BY RESOLUTION OF THE CITY COUNCIL.

12.20.235 - VIOLATION - Continuing offenses.

A. UNLESS OTHERWISE SPECIFIED, A VIOLATION OF THIS CHAPTER IS A MUNICIPAL INFRACTION AS DEFINED BY CHAPTER 1.20 AND IS SUBJECT TO A FINE AS ESTABLISHED BY RESOLUTION OF THE CITY COUNCIL.

B. Each day that a violation under this chapter continues shall constitute a separate violation of the applicable section.
