AN ORDINANCE concerning

 

Garbage and Refuse Collection at Food-Handling Establishments

 

FOR                     the purpose of requiring that garbage and refuse shall be collected from food-handling establishments no later than 8:00AM.

 

BY                        repealing and re-enacting with amendments the following portions of the Code of the City of Annapolis, 2017 Edition:

Section 10.12.090

 

WHEREAS,                     the Mayor and City Council have received documented complaints about unsightly and unsanitary refuse removal practices in the vicinity of certain Food-Handling Establishments; and

 

WHEREAS,                     these practices are detrimental to the quiet enjoyment of businesses in the City’s commercial areas by their patrons; and

 

WHEREAS,                     Section 10.16.220 of the Code of the City of Annapolis specifies that commercial refuse shall be set out for collection no earlier than 11:00PM; and

 

WHEREAS,                     the Code of the City of Annapolis presently has no provision for the collection time of commercial refuse.

 

SECTION I:                     BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the Code of the City of Annapolis shall be amended to read as follows:

 

TITLE 10 - HEALTH AND SAFETY

CHAPTER 10.12 - FOOD-HANDLING ESTABLISHMENTS

 

Section 10.12.090 Garbage and refuse.

 

Suitable receptacles equipped with tight-fitting lids for holding, without leakage, all garbage and rubbish which may accumulate shall be provided by all establishments regulated by this chapter. All garbage and waste material shall be removed from the premises at least once daily or at other intervals as the Health Officer may specify, and shall not be allowed to become a nuisance. IT IS THE ESTABLISHMENT’S RESPONSIBILITY TO ENSURE THAT GARBAGE AND WASTE MATERIAL SET OUTDOORS FOR COLLECTION SHALL BE COLLECTED NO LATER THAN 8:00A.M. EACH COLLECTION DAY IN THE HISTORIC DISTRICT. No accumulation of rubbish, useless or offensive material or other equipment or material not in use shall be permitted in any room or place where food or drink is prepared, processed, stored or served. After each collection the receptacles shall be cleaned thoroughly. The premises of all restaurants shall be kept clean and free of all rubbish.

 

SECTION II:  AND BE IT FURTHER ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that this Ordinance shall take effect thirty days from the date of its passage.
