A RESOLUTION concerning

 

City Sponsored Special Events in Fiscal Year 2019

 

FOR                     the purpose of identifying City Sponsored Special Events and waiving certain related City Fees during Fiscal Year 2019.

 

WHEREAS,                     on July 23, 2012, the Annapolis City Council resolved “that the Kunta Kinte Festival shall be co-sponsored by the City as an annual event to be held at City Dock in recognition of the significance and enduring legacy of Kunta Kinte to the City of Annapolis” (R-37-12); and

 

WHEREAS,                     on September 9, 2014, the Annapolis City Council resolved “that there shall be a waiver of full fees for the Eastport Yacht Club 32nd Annual Eastport Yacht Club Lights Parade and the Annapolis Jaycees Grand Illumination in recognition of the events’ community service” (R-24-14); and

 

WHEREAS,                     on September 9, 2014, the Annapolis City Council further resolved “that there shall be a waiver of parking fees for the Maritime Republic of Eastport Tug of War” (R-24-14); and

 

WHEREAS,                     on September 22, 2014, the Annapolis City Council resolved “that the City of Annapolis shall co-sponsor the Dr. Martin Luther King, Jr. Parade with the event organizers as an annual event to be held on the third Monday in January in recognition of the significance and enduring legacy of Dr. Martin Luther King, Jr.” (R-27-14); and

 

WHEREAS,                     during Fiscal Years 2013 through 2018 the City of Annapolis has (or will have) organized the Memorial Day Parade, the Independence Day Parade, and the New Year’s Eve celebration; and

 

WHEREAS,                     the Annapolis City Council adopted O-16-14 on October 22, 2014, establishing Chapter 14.18 of the City Code on Special Events; and

 

WHEREAS,                     Section 14.18.020 of the City Code defines “City Sponsored Events” as “special events for which the City waives some or all fees or otherwise directly participates in the cost of the event”; and

 

WHEREAS,                     Section 6.04.210 of the City Code states that “whenever a person leases, uses or occupies a City facility, the person shall be charged and pay a minimum of full fees for the use of the facility.” Examples of City facilities include public spaces, grounds, parks, athletic facilities, fields, docks, piers, wet slips, moorings, developable waters, buildings, motor vehicles, equipment, structures, rooms or other parts of public buildings. Examples of City services include traffic control, crowd control, public safety support (police or fire), trash removal, sanitary services, recycling, bulk pick-up, the provision of water, sewer, electricity, communications or other utilities, transportation, and labor. Full fees “means the value of the right to lease, use or occupy the City facility as determined by the Finance Director in a fiscal impact note, plus all costs incurred by the City of Annapolis including, but not limited to, utility costs and costs associated with municipal services (public safety, public works, custodial, renovations, repairs, maintenance, transportation and parking)”; and

 

WHEREAS,                     Section 6.04.210 of the City Code further states that the fees for City Services may be waived “by resolution of the City Council pursuant to guidelines approved by the City Council.”

 

WHEREAS,                     in prior fiscal years the City has waived certain City fees for the Martin Luther King, Jr. Parade, the Memorial Day Parade, the Independence Day Parade, the USNA Band Concerts, the Kunta Kinte Festival, the Tug of War, the Grand Illumination, the Lights Parade, and the New Year’s Eve Celebration.

 

NOW THEREFORE,

 

BE IT RESOLVED BY THE ANNAPOLIS CITY COUNCIL that the following Special Events are designated City Sponsored Events during Fiscal Year 2019 in recognition of their significance to our heritage and public service to our City:

 

                     The Independence Day Parade,

                     The USNA Band Concert Series

                     The Kunta Kinte Festival,

                     The Tug of War,

                     The Grand Illumination,

                     The Lights Parade,

                     The New Year’s Eve Celebration,

                     The Martin Luther King, Jr. Parade, and

                     The Memorial Day Parade.

 

AND, BE IT FURTHER RESOLVED BY THE ANNAPOLIS CITY COUNCIL that there shall be a waiver of full fees for the following City Sponsored Events that are not organized by the City in recognition of their public service to our City:

 

                     The Kunta Kinte Festival,

                     The Grand Illumination,

                     The Lights Parade, and

                     The Martin Luther King, Jr. Parade.

 

AND, BE IT FURTHER RESOLVED BY THE ANNAPOLIS CITY COUNCIL that there shall be a waiver of parking fees for the Maritime Republic of Eastport Tug of War.

 

AND, BE IT FURTHER RESOLVED BY THE ANNAPOLIS CITY COUNCIL that this resolution shall take effect from the date of its passage.
