Seasonal Parklet Program Standardized Lease Agreement Template
FOR the purpose of approving a standardized lease agreement template to be used by the City for those businesses interested in facilitating an outside dining experience within City owned parking spaces, as part of the City’s Seasonal Parklet Program; acknowledging the City’s Seasonal Parklet Program Operational Framework; acknowledging the City’s Seasonal Parklet Pricing Model; providing an effective date for use of said Standardized Lease Agreement Template; and matters generally relating to said Standardized Lease Agreement Template.
WHEREAS, the City is the fee simple owner of marked parking spaces and related roadways, throughout the City of Annapolis; and
WHEREAS, during the COVID -19 Pandemic City Emergency the City established a Seasonal Parklet Program to allow businesses operating adjacent to City marked parking spaces and related roadways to use such parking spaces and related roadways to facilite an outside dining experience for the safety of their business patrons; and
WHEREAS, the City having seen the popularity of outside dining and shopping among residents and visitors wishes to extend the and expand the use of city-owned streets using Parklets and obtain City Council approval of a Standardized Lease Agreement Template that would be used for the Seasonal Parklet Program and with each individual business interested in participating in such Program; and
WHEREAS, the City is willing to individually lease its marked parking spaces and related roadways to Seasonal Parklet Program business applicants for the purposes described and in accordance with the terms and conditions set forth in the Standardized Lease Agreement Template attached hereto and incorporated herein; and
WHEREAS, the Standardized Lease Agreement Template, attached hereto, incorporates the City’s Seasonal Parklet Program Operational Framework and the City’s Seasonal Parklet Pricing Model as exhibits; and
WHEREAS, Article III, Section 8 of the Charter of the City of Annapolis requires the passage of an ordinance to authorize any leases.
SECTION I: BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the Seasonal Parklet Program Standardized Lease Agreement Template, a copy of which is attached hereto and made a part hereof, for use between the City of Annapolis and those businesses participating in the Seasonal Parklet Program for the lease of certain municipal property, is hereby approved and authorized for use by the City throughout the duration of the Seasonal Parklet Program; and further that City Council approval shall not be required for any of the individual leases to be executed as part of the Seasonal Parklet Program provided that the approved Seasonal Parklet Program Standardized Lease Agreement Template is utilized in the form as attached hereto.
SECTION II: AND BE IT FURTHER ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that in accordance with Article III, Section 8 of the Charter of the City of Annapolis, the proposed leases of City-owned property will better serve the public need for which the property was acquired.
SECTION III: AND BE IT FURTHER ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the City Manager shall, within 60 days from the passage of this Ordinance, promulgate all necessary rules and regulations to effectuate and implement this Ordinance.
SECTION IV: AND BE IT FURTHER ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that this Ordinance shall take effect on ____________, 2022.
