A RESOLUTION concerning

 

Use and Deputization of Mayor’s Personal Vessel for Governmental Use

 

FOR                     the purpose of officially demonstrating that water transportation is a viable option in Annapolis that will reduce road congestion and greenhouse gas emissions; for further demonstrating that governmental services, as applicable, can be improved through the deputization of the Mayor’s personal vessel; and related other matters.

 

WHEREAS,                     the Mayor is the Chief Executive Officer and Administrative Director of the City government with a primary responsibility to formulate policy and implement long range plans for the City of Annapolis; and

 

WHEREAS,                     the Mayor is the lead ambassador for the City of Annapolis, who oversees the duties of the Annapolis Police Department, the Annapolis Fire Department, the Harbormaster, and the Recreation and Parks Department; and

 

WHEREAS,                     the City of Annapolis desires to demonstrate that water transportation is a viable option in Annapolis that will reduce road congestion and greenhouse gas emissions; and

 

WHEREAS,                     the City of Annapolis further desires to demonstrate that governmental services, as applicable, can be improved through the deputization of the Mayor’s personal vessel for governmental purposes in connection with the Mayor’s role as the Chief Executive Officer and Administrative Director of the City government; and

 

WHEREAS,                     pursuant to Section 15.04.050 of the Code of the City of Annapolis, as may be amended, any duties or responsibilities related to enforcement purposes under Title 15 of the Code of the City of Annapolis, as may be amended, may be delegated to assist with the orderly control and management of the City waterways and associated waterfront areas; and

 

WHEREAS,                     if the Mayor owns a personal vessel, then he or she shall use best efforts to use that personal vessel as a means of transportation between his or her residence and any City-work locations, events, or similar governmental activities during the term(s) elected as Mayor; and

 

WHEREAS,                     if a Mayor is willing to deputize his or her personal vessel, then the City may deploy the Mayor and that personal vessel as may be needed, in the City’s sole discretion, for public service uses and with the Mayor operating that personal vessel as an agent of the City during the term(s) elected as Mayor; and

 

WHEREAS,                      if a Mayor is willing to deputize his or her personal vessel, the Mayor shall coordinate City-use of that personal vessel with the City’s Harbormaster, and the Mayor shall call the Harbormaster’s office at 410-263-7973 or on VHF Channel 17 if he or she becomes aware of any violations of Title 15 of the City of Annapolis Code, as may be amended, during operation of that vessel in City waters; and

 

WHEREAS,                     upon deputization of the Mayor’s personal vessel, the Mayor shall maintain a VHS handheld radio on that personal vessel in working order at all times during the term(s) elected as Mayor; and

 

WHEREAS,                     upon deputization of the Mayor’s personal vessel, the Mayor shall maintain a City seal, or other City marking provided by the City’s Harbormaster, on that personal vessel at all times during the term(s) elected as Mayor; and

 

WHEREAS,                     regardless of any language to the contrary in the Code of the City of Annapolis, as may be amended, and to assist with the goals and the purposes of this Resolution, the Mayor shall be entitled to dock his or her deputized personal vessel (of any size) at any City harbor, dock, launching facility or street end; and

 

WHEREAS,                     the Mayor reserves the right to use that personal vessel for personal reasons when the City has no scheduled use of that personal vessel; and

 

WHEREAS,                      in the operation of that personal vessel, both the City and the Mayor, as applicable, shall comply with all laws, regulations, rules and orders of lawfully instituted authorities; and

 

WHEREAS,                      the Mayor shall continue to bear all expenses incidental to the possession, use, operation and maintenance of that personal vessel, including, but not limited to fuel, storage, repairs, maintenance, and insurance; and

 

WHEREAS,                     no City profits or funds will be provided to the Mayor in exchange for this donation of services as relates to use of that personal vessel, and no remuneration or government benefits of any kind or type is expected by the Mayor; and

 

WHEREAS,                     this donation of services by the Mayor is a gift with no expectation of a monetary return or gain, and which instead is to be used to further the City's safety and security and tourism efforts, and is in the best interest of the City.

 

NOW, THEREFORE,

 

BE IT RESOLVED BY THE ANNAPOLIS CITY COUNCIL that the City of Annapolis hereby supports and agrees that a Mayor with a personal vessel may have that personal vessel used and deputized for governmental use in accordance with the terms of this Resolution.
