AN ORDINANCE concerning
BUSINESS LICENSES, TAXES AND REGULATIONS - Street Caf?
FOR the purpose of clarifying the definition of street caf?s
BY repealing and reenacting with amendments the following portions of the Code of the City
of Annapolis, 2022 Edition
7.42.010
SECTION I: BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY
COUNCIL that the Code of the City of Annapolis shall be amended to read as follows:
Title 7 - BUSINESS LICENSES, TAXES AND REGULATIONS
Chapter 7.43 - STREET CAF?S
7.42.010 - Sidewalk caf?-Defined-Permit required
D. For purposes of this chapter, "sidewalk caf?" means any area situated on a public
sidewalk, and, as authorized by a lease with the City, any adjoining public street, where
food, refreshments, and/or beverages are sold by a restaurant, delicatessen, ice cream
shop or coffee shop (hereinafter "operating establishment") for public consumption at
tables or counters located on the sidewalk fronting the operating establishment. Sidewalk
caf?s shall operate only as authorized pursuant to this chapter. any area on the public
sidewalk:
1. adjacent to a food service business where food and/or beverages may be
consumed at tables and chairs whether the food and/or beverages are purchased
at the table or inside the adjacent city-licensed food service business,
2. that is permitted by the city to be a sidewalk caf? section of the public walkway.
E. SIDEWALK CAF?S SHALL OPERATE ONLY AS AUTHORIZED PURSUANT
TO THIS CHAPTER.
SECTION II: AND BE IT FURTHER ESTABLISHED AND ORDAINED BY THE
ANNAPOLIS CITY COUNCIL that this ordinance shall take effect from the date of its passage.
