A RESOLUTION concerning
Chesapeake Region Accessible Boating - Adaptive Boating Center
FOR the purpose of recognizing and applauding Chesapeake Region Accessible Boating (CRAB); and approving a waiver of any further planting off-site or fee-in-lieu of planting at the Adaptive Boating Center (ABC) property development pursuant to City Code Section 21.54.060.H - requests for reasonable accommodations for the needs of disabled citizens. reduced fee-in-lieu of planting at the Adaptive Boating Center (ABC) property development.
WHEREAS, Chesapeake Region Accessible Boating is an Annapolis based 501(c)3 nonprofit organization that is the sole provider of adaptive sailing and boating for people with disabilities on the Chesapeake Bay; and
WHEREAS, the City of Annapolis purchased marina property on Bembe Beach Road, Annapolis, Maryland and has leased the property to CRAB under a long-term 40-year lease for the purpose of developing an ABC to further its mission, outreach, and boating programs; and
WHEREAS, the ABC is being built with the financial support of the State of Maryland, Anne Arundel County, the City of Annapolis, and private funds raised by CRAB; and
WHEREAS, the ABC serves the needs of the public and while it will be owned by the City of Annapolis, it will be operated and managed by CRAB; and
WHEREAS, the property has been operated as a marina for the past 50-years and will require substantial grading to be brought into compliance with the Americans with Disabilities Act standards for accessibility for people with disabilities who will be able to sail and boat at the ABC; and
WHEREAS, City Code Section 21.54.060.H expressly provides for certain allowances for development of property within the Critical Area that accommodates accessibility for individuals with disabilities, such as the development of the ABC property; and
WHEREAS, the City Council wishes to reduce CRAB’s fee-in-lieu of planting to the minimum amount allowed in accordance with COMAR 27.01.09.01-5; and
WHEREAS the approved development plans for the ABC property provide for the: propagation of over 400 trees, shrubs, and plants to meet Critical Area Code requirements; installation of solar power for the ABC buildings; three electric vehicle charging stations; permeable paver parking spaces; and two major storm water retention areas; and
WHEREAS, the City Council recognizes the extraordinary effort CRAB has incorporated into its design of the property in order to achieve the upmost accessibility and sustainability of what surely will be the premier adaptive boating center nationwide; and
WHEREAS, the City Council wishes to acknowledge that the requirements for planting at the ABC property in accordance with its development plans as approved by the Department of Planning & Zoning have not only been met but, in fact, exceed its planting and environmental obligations.
NOW, THEREFORE,
BE IT RESOLVED BY THE ANNAPOLIS CITY COUNCIL that the City of Annapolis recognizes and applauds CRAB for its achievement in actively negating any environmental impacts of the ABC development and hereby approves a waiver as allowed under City Code Section 21.54.060.H of any further planting off-site or fee-in-lieu of planting at the ABC property reduced fee-in-lieu of planting of $1.50 per square foot at the ABC property.
