AN ORDINANCE concerning
Police Department -- Property and Contraband Disposal
FOR the purpose of clarifying that Annapolis will follow state rules on the disposal of abandoned vehicles and generally dealing with property and contraband disposal.
BY repealing and reenacting with amendments the following portions of the Code of the City of Annapolis, 2024 Edition
2.36.060
SECTION I: BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the Code of the City of Annapolis shall be amended to read as follows:
Title 2 - ADMINISTRATION
Chapter 2.36 - Police Department
Section 2.36.060 - Property and contraband disposal-Authorized.
A. Authorized. The Police Chief may destroy any contraband articles or goods seized by or delivered to the Police Department, after removing any money.
B. The Police Chief shall sell at public auction all lost, abandoned, unclaimed, forfeited, undistributed contraband or stolen property, remaining in the possession of the Police Department for a period of six months without a lawful claimant, except that unclaimed bicycles may be auctioned after a three-month waiting period. This subsection shall not apply to weapons, narcotics, dangerous drugs and alcoholic beverages.
B. Disposal of Contraband or Stolen Property.
1. With the exception of paragraph 2, the Police Chief shall sell at public auction all lost, abandoned, unclaimed, forfeited, undistributed contraband or stolen property, remaining in the possession of the Police Department for a period of six months without a lawful claimant.
2. Unclaimed bicycles may be auctioned after a three-month waiting period.
3. Abandoned vehicles will be disposed of pursuant to the Transportation Article § 25-201 -- § 25-210 of the Maryland Code.
4. This subsection shall not apply to weapons, narcotics, dangerous drugs and alcoholic beverages.
C. Prohibited From Bidding or Purchasing. An elected official, appointed official or employee of the City, or the immediate family of the official or employee, shall neither bid nor purchase an item.
SECTION II: AND BE IT FURTHER ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that this ordinance shall take effect upon passage.
