AN ORDINANCE concerning

 

Streets - Turtle-friendly curbs

 

FOR                     the purpose of requiring turtle-friendly curbs in environmentally critical areas of the City; correcting a typo in Title 14; creating a "Streets" chapter and a "Curbs" section in Title 14; and generally related to street curb requirements.

 

BY                     amending and reenacting the following portion of the Code of the City of Annapolis, 2022 Edition

                     Title 14

 

BY                     enacting with amendments the following portions of the Code of the City of Annapolis, 2022 Edition

                     Chapter 14.01

                     Section 14.01.010

                     Section 14.01.020

 

 

SECTION I:                     BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the Code of the City of Annapolis shall be amended to read as follows:

Title 14 - STREETS, SIDEWALKS, PUBLIC PLACES, AND SMALL CELL SYSTEMS

 

 

 

CHAPTER 14.01 - STREETS

 

SECTION 14.01.010 - DEFINITIONS.

                     "DIRECTOR" MEANS THE PUBLIC WORKS DIRECTOR OR THEIR DESIGNEE.

 

SECTION 14.01.020 - CURBS.

                          TURTLE-FRIENDLY CURBS. IN AN EFFORT TO PROTECT CRITICAL AND ENDANGERED NATIVE MARYLAND TERRAPINS AND TURTLES, THE CITY REQUIRES CERTAIN TYPES OF CURBS IN NEW CONSTRUCTION ALONG NON-ARTERIAL, CITY-OWNED AND/OR MAINTAINED STREETS LOCATED WITHIN THE CITY'S CRITICAL AREA DEFINED IN TITLE 17 § 04.180. 

                          1.                     THE CURBS SHALL CONSIST OF:

                           a.                     SLANTED/SLOPED CURB, ALSO KNOWN AS A MOUNTABLE CURB; OR

                           b.                     ANGLED CURBS; OR

                  c.                     OTHER TYPE OF CURB ALLOWING TURTLES AND TERRAPINS TO EXIT THE STREET.

2.   THE DIRECTOR SHALL DEVELOP AND ADHERE TO A NEW CONSTRUCTION SCHEDULE FOR REPLACING EXISTING CURBS WITH TURTLE-FRIENDLY CURBS AS DEFINED IN THIS SECTION, TITLE 14 § 01.020.

 

SECTION II:  AND BE IT FURTHER ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL the Department of Public Works shall, within 180 days of the effective date of this legislation, promulgate any rules, regulations or changes to the department's Standard Details for Construction and the Design Manual necessary to implement the intent of this legislation.

 

SECTION III:  AND BE IT FURTHER ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that this ordinance shall take effect from the date of its passage.
