AN ORDINANCE concerning

 

PUBLIC SERVICES - Water Service - Billing - Waiving Late Penalties

 

FOR                     the purpose of of allowing the Finance Director to waive certain late utility penalties, and generally regarding City of Annapolis utility fees.

 

BY                     adding the following portions to the Code of the City of Annapolis, 2022 Edition

                     16.04.090

 

BY                     repealing the following portions of the Code of the City of Annapolis, 2022 Edition

                     16.08.060                     

                     16.16.020

 

 

SECTION I:                     BE IT ESTABLISHED AND ORDAINED BY THE ANNAPOLIS CITY COUNCIL that the Code of the City of Annapolis shall be amended to read as follows:

 

TITLE 16  - PUBLIC SERVICES

Chapter 16.04 - WATER AND SEWER SERVICE GENERALLY

Section 16.04.090 - BILLING AND LATE FEES

 

                     A.  A BILL FOR WATER AND SEWER SERVICE SHALL BE ISSUED EACH QUARTER UNLESS THE CITY HAS RECEIVED A WRITTEN REQUEST TO TERMINATE SERVICE FROM THE PROPERTY OWNER OR PERSON BEING BILLED FOR THE SERVICE.

 

                     B.  A PENALTY OF TEN (10) PERCENT SHALL BE ADDED TO EACH BILL UNPAID AFTER THIRTY (30) DAYS. IF REQUESTED BY A CUSTOMER, THE FINANCE DIRECTOR MAY WAIVE THE PENALTY CHARGE. WAIVERS OF PENALTY CHARGES SHALL BE LIMITED TO ONE PER CUSTOMER PER FISCAL YEAR.

 

                     C.  ALL CHARGES FOR WATER AND SEWER SERVICES SHALL BE A LIEN UPON THE PROPERTY TO BE COLLECTED IN THE SAME MANNER AS MUNICIPAL TAXES ARE COLLECTED.

 

                     D.  WHEN THE OWNER OF A RESIDENTIAL PROPERTY TERMINATES WATER AND SEWER SERVICE FOR AT LEAST ONE CALENDAR QUARTER, THE CHARGE FOR REFUSE COLLECTION SHALL ALSO BE TERMINATED UNTIL WATER AND SEWER SERVICE IS RESTORED.

Chapter 16.08 - WATER SERVICE

16.08.060 - Billing.

 

Section 16.08.060 - Billing.

 

                     A.  A bill for water service shall be issued each quarter, unless the City has received a written request to terminate service from the property owner or person being billed for the service.

 

                     B.  A penalty of ten percent shall be added to each bill unpaid after thirty days.

 

                     C.  All charges for water shall be a lien upon the property to be collected in the same manner as municipal taxes are collected.

 

                     D.  When the owner of a residential property terminates water service for at least one calendar quarter, the charge for refuse collection shall also be terminated until water service is restored.

                     A.  A penalty of ten percent shall be added to each sewer service bill unpaid after thirty days.

 

                     B.  All charges for sewer service shall be a lien upon the property to be collected in the same manner as municipal taxes are collected.

                     

 

 

SECTION  II:   AND  BE  IT  FURTHER  ESTABLISHED  AND  ORDAINED  BY THE ANNAPOLIS CITY COUNCIL that this ordinance shall take effect from the date of its passage.
